## Terms of Service
By downloading or using the AI Upscale mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. Your use of the App is also governed by Apple's standard End User License Agreement (EULA).
**Subscriptions**
The App offers premium features via auto-renewing subscriptions. By subscribing, you agree to pay the subscription fees. Payment will be charged to your Apple ID Account at confirmation of purchase.
Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your App Store account settings after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
**Use of the Service**
You agree to use the App only for its intended purpose of enhancing photos. You must not use the service for any illegal or unauthorized purpose. You are responsible for ensuring you have the rights to any content you process through the App.
**User Content & Data Privacy**
You retain all ownership rights to the photos you process. Our use of your data is governed by our Privacy Policy (detailed below), which is incorporated into these Terms by reference. We are committed to protecting your privacy and only use your photos to provide the enhancement service, after which they are immediately deleted from our servers.
**Intellectual Property**
The App and its original content, features, and functionality are and will remain the exclusive property of Lyndl and its licensors.
**Disclaimer of Warranties**
The App is provided "AS IS" and "AS AVAILABLE", without any warranties, express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free.
**Limitation of Liability**
In no event shall Lyndl, nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of the App.
**Governing Law**
These Terms shall be governed by the laws of the jurisdiction in which our company is based, without regard to its conflict of law provisions.
**Changes to Terms**
We may update our Terms from time to time. Continued use of the app after such changes constitutes acceptance of the new terms.

## Privacy Policy
Lyndl ("we", "our", "us") operates the AI Upscale mobile application (the "Service"). This section informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Service.
**Information We Collect**

* **Photos You Provide:** When you use our photo enhancement feature, your photos are securely and temporarily uploaded to our servers for AI processing. We do not store, view, or use your photos for any purpose other than to provide the enhancement service.
* **Transaction Information:** If you purchase a subscription, Apple manages the transaction. We receive anonymized transaction data from our partner, RevenueCat, which helps us validate subscriptions. We do not have access to your payment details or personal billing information.
* **Usage Data & Analytics:** We collect anonymized data about how you interact with our Service, such as feature usage frequency and crash reports. This helps us understand user behavior, diagnose technical issues, and improve the app's performance.
**How We Use Your Information**
* **To Provide the Service:** Your photos are used exclusively to perform the AI enhancement and are deleted immediately after processing.
* **To Manage Subscriptions:** We use anonymized data from RevenueCat to verify your subscription status and unlock premium features.
* **To Improve Our App:** We analyze aggregated, anonymized usage data to identify areas for improvement and to fix bugs.
**Data Security and Retention**
We are committed to protecting your data. Your photos are encrypted during transmission and are permanently deleted from our servers immediately after the enhancement process is complete. We do not retain copies of your images. Anonymized usage and transaction data is retained only as long as necessary to provide and improve our Service.
**Third-Party Services**
We use RevenueCat to manage and verify in-app subscriptions. RevenueCat may collect and process anonymous user and transaction identifiers to facilitate this. You can review RevenueCat's privacy policy for more details on how they handle data.
**Your Privacy Rights**
You have full control over the photos you choose to process. Enhanced images are saved locally to your device, and you can manage or delete them at any time. You can also manage your subscriptions directly through your Apple ID account settings.

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. You are advised to review this Privacy Policy periodically for any changes.
